Even if the tranny was out of the way, you still have to deal with all the tubes connected to the EGR valve. Once the plenum is removed, you can get to the two bolts that hold the EGR to the back of the lower plenum. However, you can still bypass the EGR without necessarily physically removing it. Get the kit, block the underside ports on the plenum and you should be fine.
