Court this week over that exact thing. Apparently this guy was a convicted felon (fraud and sexual asault, IIRC). Well, his former employer wrote him two excellent letters of recommendation from both his immediate superior and the president of the company. He then got a job at a nursing home processing the patients/ residents benefits, and he ended up using the information to commit identity theft. The nursing home is suing his former employer on the basis that their letters of recommendation pretty much constituted fraud. I guess we'll hear later this week what the men in black (robes) decide.
