small claims court wouldn't give him anything. the judge would tell Ed that if he didn't like the condition the car, then he shouldn't have put a deposit down on it in the first place. As far as their contract goes, since this was a private agreement, the buyer has to go by the sellers terms. It doesn't matter what Ed says, if Mr. Toilette ( no pun intended by the way) wrote out a contract for a deposit, and Mr. Ed signed it, poor Mr. Ed is willingly agreeing to any and all terms set by Mr. Toilette.
