I dealt with this with my previous '96 NA> (90)TT swap. In order to pass in CA, had to keep original '96 motor, ECU, and all the smog goodies. I was keeping all of my '96 parts stored for the two years till the next smog test. Never had to swap the OBD II stuff back in though. Totaled the car, and eventually put my built motor into a 90TT. If your '96 is in amazing shape like mine was, then I think its worth it to do the swap every two years. It wasn't my daily driver, and I wasn't planning on selling it. Plus it's not THAT hard to pull the engine, install OBD II, pass smog, pull it all apart again, and put all the good stuff back in LOL.
