as it was an automatic, there was no safety switch installed from the factory. (Also, 7 years is past the statute of limitations on a situation like this, fyi.) The auto safety switch is in the brake pedal. During your swap did you install a 5-speed ecu? From what I gather, you're insinuating your mechanic was supposed to do a complete swap, including the body harness, ecu, related switches/plugs and have it all exactly as a stock manual 300zx? Because either that is required for what you expected, or at a minimum they would have had to have rewired everything properly, and you'd still have to have a 5-speed ecu to make it function. Many 5-speed swaps skip the clutch engagement switch due to the rewiring that is required. You can always add a 30 amp relay and just use the stock safety switch on the pedal and wire the relay to not allow the ignition to engage unless the pedal is engaged, but there again I wouldn't expect your average shop to go through all that either. But, if the accident happened when you were not in possession of the vehicle, the shop is technically responsible for any damage to your vehicle during their possession, without question. They have insurance to cover them for that, and if they didn't and you had full coverage they should have covered your car and gone after the shop. If you didn't, you'd have been out of luck unless you had chosen to sue him personally.
