Because only an attorney could figure out how this poor guy, who died because of some idiot's negligence, could have been at fault. A little thing called depth perception and judging the rate at which oncoming traffic is approaching your position should be considered here. He likely saw these cars coming toward him but they should have been going say 35 mph and were going more than twice that fast. I say put the Eclipse AND Mustang driver behind bars for 5-10 and see if that sends a message to other irresponsible drag racers out there. It makes me sick...
