Message	in new york state at least, the person entering traffic is responsible for a safe entry. if you get hit from behind while entering trafic it is ALL YOUR FAULT. when i was younger i was hit while pulling out of 7-11 by someone who was passing in a no passing zone. (so he hit me while traveling on the wrong side of the rd) verdict:100% my fault. Taught me a valuable lesson. assuming that everyone else is following the rules is setting yourself up.
