Message fire the tech if he gets caught passing a car like that. as far as hardpipes -technically it falls under "modified" on the air intake system. I agree it would make no difference - but CARB ( california air resources board) requires the part be "approved" ( expensive) and stamped with their number before it's legal. ( example - the fresh air intake kits for many cars with K&N type filters).

odds are , once a smog tech sees one thing questionable - he will start looking for more. If it all looks stock, then they assume it is. Everyone is right - we have the government we voted for. The tech is doing the unenviable task of following the program rules
