Message The steps are, you can call the court and say you want to do a "trial by declaration". They will send you the paperwork required. You must submit the paperwork, the full bail amount, along with your statement BEFORE the due date (court date).

If you win, you get the full bail amount minus court fees, refunded back to you.

Now, I'm not sure what you mean by a "cover letter". Is it a letter to request "trial by declaration" or do you mean the actual declaration itself?

In either case, in a request, if you choose not to call the clerk, you just write a letter requesting a "trial by declaration". Be sure to include your docket number, as they won't know what to do without it.

In the declaration, you must state your facts (not opinions, ok; facts only!) and tell the judge what to do with the facts. You MUST ask for a dismissal, otherwise he won't dismiss it. Give your reasons for the dismissal. Sound professional and do your homework.
