Let's look at a different scenario and see how you would feel. You go shopping for a car. You find one you like and put down a deposit for the dealer to hold it until you can have your wife look at the car. Wife looks at it and hates it. Would you be happy if they kept your deposit?

Or you decide to buy a house, you put down a deposit and either as a result of a home inspection or you find another house down the street for less money, you decide not yo buy. Unless the binder was described as non-refundable, the seller has to give you your deposit back. We own a title company and deal with that all the time.

I'd give it back just because Karma can be a bitch.
