Message We are talking about someone having to prove thier innocence in order to retain their property, in this case being a car, and a law that allows any interpretation of "street racing" to snare someone into this assumed guilt....

Not to mention a completly(IMO) disproportionate penalty for a victimless crime.

I also think you have me confused with a whole 'nother group of folks who have paranoid views of law enforcement professionals. Nothing could be further from the truth and I have made remarks here many times over consistent with that.

A crime of possessing contraband is very different from a crime that is an action not involving any illegal possessions

That's the thing, it doesn't come up in court because under these particular seizure laws you have no wicket/process/criteria governing what is and isn't considered in violation, it is left wholly up to your judgement and interpretation

No you don't know that, you are ASSUMING it based on the sensible seizure laws in your particular jurisdiction.

Again we are referring to these laws that propose on-the-spot seizures. The article makes no mention of conviction, due process, nothing. For all appearances, and obviously by no mistake, they want people to think they can take the car that night at the moment of citation and keep it. Which at the least is bullshit, and is plainly unconstitutional. No one is advocating "getting away" with anything, but there is no excuse for not enforcing laws and prosecuting people with the due process that this country was founded on.

There is no excuse.
