Message in VA that's not true. I think it might vary from state to state though.

It's the employeer's discretion if he wants to pay someone salary or hourly. Here are some examples of my jobs.

In HS I worked for a Pizza/Italian restrauant. I was paid hourly. I worked there on and off for a couple of summers and became good friends with the owners. Then I came back one summer and they decided to pay me salary. They did that with a couple people there. It was their discretion.

I'm a Software Design Engineer 1 now. I am paid salary. It's basically and entry level position out of college.

My wife is an Electrical Engineer. During the summer in college she was paid hourly. Then another summer they put her on as salary.

If you are being paid hourly, the have to pay you for overtime. If you are salary, they do not have to pay you for overtime.

That's how it works in VA. I'm pretty sure it's a state by state law. I remember working for a company in VA that was started in CA. So I had CA laws on my side. Anything beyond 8 hrs a day was time & a half. Anything beyond 12 hrs a day was double time. Anything beyond 40 hours a week was time & a half. One week I worked 7 14 hour days. I made a TON of money for that week.

hours 0 - 8 I made regular time. 8 - 12 I made time & a half. 12 - 14 I made double time.

Then on top of that hours 0 - 40 (for the week) was my standard rate. Then after the 40 I got time & a half. I made something like $1700 in one week. Remember that was under CA laws at the time while I was working in VA. I don't know if the company decided to do it that way or if they were required.

But basic rule of thumb....hourly...get paid for overtime....salary....you don't.
