Since you were not ticketed, you will need to contest the issue with your insurance company. They will take your statement and the other drivers plus any witnesses. If they find in your favor (doubtful) that you were not at fault they will not pay for the other drivers damage, you can then proceed to file a claim against the other driver. She then can do the same thing. IMO you are looking at a long shot. Insurance companies are in cahoots on these deals; what goes against them this time, may be in their favor the next. You do not have to be ticketed to be found at fault. The accident will count against you at the DMV and w/your insurance.
