Well if you could prove it wasn't you at the time, I'm sure they'd waive it, but obviously they tracked him down through the rental company as he said he was renting the car... basically if you could provide photographic proof (i.e. scan of driver's license) to show it wasn't you, and provide receipts of transactions from the day showing you were somewhere else at the time, then you'd be able to get out of it.
