See U.S. District Court Southern District of New York opinion John Doe/ACLU v. Ashcroft et. al., most importantly views expressed by Judge Marrero. [ http://www.nysd.uscourts.gov/rulings/04CV2614_Opinion_092904.pdf ] A viewpoint on the case: [ http://practice.findlaw.com/cyberlaw-1104.html ] Also, another article published by Ramasastry: Knowledge, Technology, & Policy. Fall2003, Vol. 16 Issue 3, p7. These deal specifically with the USA PATRIOT Act of 2001, but you can relate them to elements of Big Brother as the arguments deal with unconstitutional surveillance, search and seizure, etc. I recently wrote a paper on the matter and I have to defend it tomorrow. If you would like anything further, feel free to email me.
